The new USCIS Keeping Families Together Process, available starting August 19, 2024, offers a crucial opportunity for noncitizen spouses of U.S. citizens.

By Michael H. Markovitch, Esq. on August, 19, 2024

The USCIS Keeping Families Together Process represents a lifeline for many families facing the uncertainty of immigration challenges. If you or your spouse entered the U.S. without inspection but have made this country your home since June 17, 2014, this process could be the key to staying together. Filing certain USCIS forms allows eligible noncitizen spouses to apply for parole in place, providing the opportunity to remain in the U.S. legally without fear of deportation.

Eligibility Criteria for the Program

Meeting these requirements is the first step towards securing your family’s future in the U.S.

  • For Noncitizen Spouses:
    • Marriage Validity: Your marriage to a U.S. citizen must be legally recognized.
    • Continuous Presence: You must have continuously lived in the U.S. since June 17, 2014.
    • Good Moral Character: Demonstrating good moral character is crucial—a criminal record or significant immigration violations may affect your eligibility.
  • For Noncitizen Stepchildren:
    • Age Limit: Stepchildren must be under 21 years old.
    • Marital Status: The stepchild must be unmarried.
    • Stepchild Relationship: The relationship must have been established before the child turned 18.

Key Dates to Remember

Timing is everything when it comes to immigration processes. Keep these critical dates in mind:

  • Start Date: August 19, 2024—This is when you can start submitting your application. Don’t wait until the last minute—preparing early can help avoid unnecessary delays.
  • Follow-Up: Check the status of your application 30 and 60 days after submission to ensure everything is on track.
